1. Acceptance of These Terms
By accessing or using HomeTrack Market (the "Platform"), operated by MINAS Technologies Inc. ("we", "us", or "our"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Platform.
These Terms apply to all users of the Platform, including property owners ("Sellers"), buyers ("Buyers"), and licensed real estate professionals ("REALTORS®" or "Agents").
2. What HomeTrack Market Is
HomeTrack Market is an online real estate marketplace that connects property owners, buyers, and licensed REALTORS® in Canada. The Platform provides tools for listing properties, searching listings, making offers, managing transactions, and accessing AI-assisted tools such as the Listing DNA Agent and Seller Net Sheet.
HomeTrack Market is a technology platform, not a real estate brokerage. We do not represent any party in a transaction, do not hold a real estate licence, and do not provide legal, financial, or tax advice. All real estate transactions facilitated through the Platform must be formalized through a licensed real estate lawyer.
3. User Accounts
You must create an account to list properties, make offers, or access transaction tools. You agree to provide accurate and complete information when registering, including your legal name, email address, and phone number.
You are responsible for keeping your password secure and for all activity under your account. You must not share your account credentials with others.
Identity verification is required before making offers or listing properties. If you change your legal name after verification, your account will be frozen pending re-verification to protect all parties from impersonation.
4. Listing a Property
Sellers may list properties by providing accurate address, pricing, and property details, and uploading proof of ownership documents for admin review. All listings are subject to approval before going live.
Sellers warrant that they are the legal owners of the properties they list and that all information provided is accurate and not misleading. Sellers are solely responsible for the content of their listings, including photos, descriptions, and answers provided to the Listing DNA Agent.
REALTORS® may list properties manually or through the REALTOR.ca DDF® feed. DDF®-sourced listings include attribution to the listing brokerage and agent as required by the Canadian Real Estate Association (CREA).
5. Making Offers
Buyers may submit offers on active listings. Offers submitted through the Platform are non-binding expressions of interest and do not constitute a legal contract. A formal purchase agreement must be prepared by a licensed real estate lawyer.
Buyers must complete identity verification before making an offer. Sellers may require pre-qualification questions before accepting an offer.
When a Seller receives an offer they wish to pursue, a one-time $25 CAD platform fee is charged to unlock the Buyer's contact details and activate the Transaction Tracker. This fee is non-refundable. Declining an offer is always free.
6. Transaction Tracker
The Transaction Tracker is an optional, advisory tool that guides Buyers and Sellers (or Buyers and Agents) through the steps between an accepted offer and the formal legal process. It covers showings, finalizing terms, deposit, mortgage approval, inspection, waivers, and connecting with lawyers.
The Transaction Tracker has a facilitating role only. All arrangements, decisions, and disputes remain solely between the parties. The Platform does not regulate, enforce, or guarantee any transaction outcome.
Both the owner-to-buyer Transaction Tracker and the REALTOR Transaction Tracker are subject to these Terms.
7. REALTOR® Workspace
Licensed REALTORS® may use the REALTOR Workspace to manage listings, leads, offers, and transactions. Agents are responsible for maintaining accurate profile information, including their brokerage details and CREA/DDF® credentials.
Agents using the DDF® feed are responsible for compliance with all applicable CREA rules, including proper attribution of listing data. The Platform displays "Listing Courtesy of [Brokerage]" on all DDF®-sourced listings.
The REALTOR Transaction Tracker includes additional steps such as representation agreements, MLS sheet upload, and waiver management. Agents are responsible for preparing and uploading all required documents.
8. AI Tools
The Platform provides AI-assisted tools including the Listing DNA Agent, Seller Net Sheet AI Agent, and Buyer Assistant. These tools generate responses based on listing data and user input. AI-generated content may be inaccurate or incomplete and should not be relied upon as legal, financial, or professional advice.
Sellers who activate the Listing DNA Agent are responsible for the accuracy of the information provided through the Property Passport. Buyers should verify all property details during a showing or through a professional inspection.
9. Professional Recommendations
The Platform may display nearby real estate lawyers and home inspectors based on location data from third-party sources. These listings are provided for informational convenience only and are not endorsed, verified, or recommended by us. You must conduct your own research before hiring any professional.
10. Prohibited Activities
You must not:
• List a property you do not own or are not legally authorized to sell
• Provide false, misleading, or fraudulent information
• Use the Platform for any illegal purpose
• Attempt to circumvent the $25 platform fee by contacting Buyers outside the Platform before unlocking their details
• Harass, threaten, or defraud other users
• Scraping, copying, or redistributing listing data without authorization
• Impersonate another person or entity
11. Fees
The Platform is free to use for browsing, searching, and listing properties. The only fee is the $25 CAD platform fee charged to Sellers (or Agents) to unlock a Buyer's contact details and activate the Transaction Tracker. This fee is processed securely through Stripe and is non-refundable.
We reserve the right to introduce additional fees in the future. Any changes will be communicated in advance.
12. Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that listings are accurate, that offers will be accepted, or that transactions will complete successfully.
We are not a party to any real estate transaction and are not responsible for the actions of Buyers, Sellers, or Agents. You use the Platform at your own risk.
13. Limitation of Liability
To the maximum extent permitted by law, MINAS Technologies Inc. shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform, including but not limited to failed transactions, misrepresentation, fraud, or data loss.
Our total liability for any claim arising from your use of the Platform shall not exceed the fees you have paid to us in the preceding 12 months ($25 CAD maximum).
14. Termination
We may suspend or terminate your account at any time if you violate these Terms or if we believe your activity poses a risk to the Platform or other users. You may delete your account at any time by contacting support.
Upon termination, your listings and offers may be removed, and active Transaction Trackers may be cancelled. These Terms remain in effect even after your account is terminated.
15. Governing Law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of Alberta.
16. Changes to These Terms
We may update these Terms from time to time. We will notify users of material changes through the Platform or by email. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

Identity verification documents (such as your Driver's License or Passport) and proof of ownership documents are stored securely and accessible only to authorized administrators for verification purposes. We do not sell or share your personal data with third parties for marketing purposes.
